Against the Constitutional principles, the classes are aimed to provide students with knowledge of the legal framework relating to the evolution of the State intervention in the economic context.

At the end of the classes, students will be capable of: (a) singling out the main ways by which governments carry out their activities in the economic environment without necessarily refer them to market competition; (b) critically understanding the different legal tools and modes whereby to ensure the intervention of public authorities within the economy; (c) understanding the role of public administration, especially in the delivery of services of general interest.

Course contents

Against international and EU law background, this course is intended to analyse institutional, legal and organisational aspects of public regulation of economic activities. In this respect, the legal forms that are applicable to the intervention of public authorities within the economic context and to their relationships with for profit organisations will be studied.

Assessment methods

Final examinations are written and will be organised according to the instructions that will be communicated by Professor Santuari at the beginning of classes. The examinations are aimed at assessing students' theoretical understanding and critical analysis.

Only students who will pass the first part of the examination will be allowed to take the second part of the examination.

If students fail the first part of the examination or refuse the grade given, the subsequent tests will refer to the whole programme.

If students fail the second part of the examination or refuse the grade given, they will have to take the total examination. Accordingly, the grade of the first examination will be void.

The corse is part of an integrated module with Private Law. Therefore, the final score will be registered only after passing both courses by Professor Francesco Quarta.
