Learning outcomes

The course aims at conveying the basics on restorative justice from the theoretical and practical perspective.

 

Course contents

  • History and cultural foundations of Restorative Justice;
  • Contemporary accounts and different contexts of use;
  • The normative model: international and national legal sources;
  • The main characters: the victim; the perpetrator; the community; the facilitator;
  • Restorative processes and restorative outcomes;
  • Rights of the stakeholders and necessary information;
  • Restorative justice in the Italian system: a) juvenile justice; b) judge of peace; c) ordinary criminal trial; d) sentencing and execution;
  • Restorative justice and traditional penal system: antagonism and synergy. 

Readings/Bibliography

A comprehensive reform is currently under discussion, therefore any reading assignment would be outdated by October. 

Therefore, the reading list will be made available at the beginning of the course.

Teaching methods

The lecture will cover the entire program. Further readings on the subject of each lecture will be made available through Virtuale.

At the end of the course, the teacher will hold a seminar on legal writing to prepare students for the redaction of the short essay (see: Assessment methods). 

Assessment methods

Students will be required to write a short essay (min. 2.500 words, footnotes excluded) on a topic that has to be previously agreed on with the teacher. 

Teaching tools

Teaching material will be made available for every lecture. The seminar on legal writing will be supported with an interactive hypertext.
