Learning outcomes

The aim of the course is to give a complete survey of the juridical and judicial landscape of the Italian and European systems in the topic of public procurement and contract in the specific sport field.

Course contents

General outlines of administrative law

- sources of law;

- fundamental laws and principles;

- administrative procedure within the framework of Law No. 241/1990.

- The basic characteristics of sports associations;


- the traditional Italian approach and the impact of European law;


- the current discipline of public partnership and PPP: principles,conceptual bases and rules, starting from the most important European directives and the Italian Public Procurement Code;

- the sector's independent regulator and supervisor: the National Anticorruption Authority.

- the contracting authorities: public bodies and bodies governed by public law;

- the innovations made by the New Public Contracts Code to the Public-Private Partnership.

- the figure of Project Financing and Concession.

Slides to be provided to students prior to the conduct of each lecture.

Teaching methods

Lectures will combine theoretical exposition with practical work, such as reading tender notices published by national contracting authorities and analyzing rulings of the European Court of Justice.

Assessment methods

Classes are taught on a semester-by-semester basis.
The profit examination will be conducted in oral form. The interview will cover the topics indicated in the "Program and Contents" section.
The evaluation of the test will be made taking into consideration:
- the knowledge of institutional profiles;
- The ability to make connections between the different parts of the program;
- the ability to develop critical arguments;
- the articulation of the exposition;
- the accuracy of the exposition
Final grade grading:
- preparation on a limited number of topics covered in the course and ability to analyze emerging only with the help of the lecturer, expression in overall correct language → 18-19;
- preparation on a limited number of topics covered in the course and ability to analyze independently only on purely executive issues, expression in correct language → 20-24;
- preparation on a large number of topics covered in the course, ability to make independent choices of critical analysis, mastery of specific terminology → 25-29;
- substantially comprehensive preparation on the topics covered in the course, ability to make independent choices of critical analysis and linking, full command of specific terminology and ability to argue and self-reflect → 30-30L

Before each lecture, special explanatory slides will be provided in conjunction with the normative sources of the topics that will be covered during the course.
