Learning outcomes

The student will learn the fundamental principles of criminal law, in particular lectures will focus on the "general theory" of the offence and the penalty and on the offences envisaged by the Criminal Code and by Special Legislation.

Course contents

The course concerns the ‘general part’ of criminal law; it consequently focuses on constitutional principles that govern the area and on the fundamental elements of the offence.

Basic topics are constitutional guarantees such as: the principles of legality and mens rea; the harm principle, the reasonableness and equality principles; the sources of criminal law; the fundamental components of crimes, the main features of offence (in particular, attempted crimes and conspiracy); the penalties.

Specific issues are: the protection of health and safety at work, of the environment and food safety (and the related case law); the regulation of the corporate liability for criminal offences ex Legislative Decree No. 231/2001 (and related case laws).



 

Readings/Bibliography

Specific learning materials will be provided during the lectures to the students.

Additional bibliographical references concerning specific topics may be provided during the lectures. In this regard, the requests of the studends will be considered.

The exam will be based on the slides and material made available and/or indicated in class and on the chapters of the adopted book specified during the lectures.

Teaching methods

Lectures, combined with moments of dialogue and debate with students on topics in which they have shown particular interest.

Assessment methods

The exam will consist of an oral interview and the oral test will focus on topics related to those indicated in the "Contents" section.

The exam will be based on the slides and material made available and/or indicated in class and on the chapters of the adopted book specified during the lectures.

Teaching tools

The materials will be provided and/or indicated during the course of the lectures.

Students who, for disabilities or specific learning disorders (DSA), require compensatory tools may inform the teacher of their needs so that they can be addressed to competent persons and find the most appropriate support measures.
