93634 - DIRITTO ECCLESIASTICO COMPARATO E DIRITTI UMANI

Academic Year 2022/2023

  • Teaching Mode: Traditional lectures
  • Campus: Ravenna
  • Corso: First cycle degree programme (L) in Mediterranean Societies and Cultures: Institutions, Security, Environment (cod. 5696)

Learning outcomes

The course provides the basis for understanding and analyzing phenomena related to intercultural and pluri-religious social experience with specific reference to conflicts emerging from the coexistence of different cultural systems. The intense dialogic polarization of the lessons is based on respect for the heterogeneity of the visions expressed, both in content and language. At the end of the course, the student is able to develop an autonomous capacity for judgment on human rights and their declinations from an intercultural perspective and is able to apply the skills acquired to concrete cases, differentiated according to cultures and of the religions they belong to, in a critical way and with sufficient mastery of exhibition techniques.

Course contents

The course aims to investigate the interactions between human rights and religious factors from a comparative point of view to understand to what extent they are compatible with each other or if, otherwise, they do not constitute an obstacle to each other's realization. The course is divided into two parts. In the first part, extremely topical practical cases will be dealt with, such as those affecting the so-called end of life, think for example of the voluntary termination of pregnancy and the recent ruling of the Supreme Court of the United States or the age-old question of indirect euthanasia. Each case will be analyzed under a triple profile: 1) the main regulatory solutions adopted by the various States; 2) the point of view of religious rights and their contribution or not to the affirmation of human rights; 3) the jurisprudential solutions adopted by the European Court of Human Rights (ECHR) or by the Supreme Court of the United States of America (SCOTUS) to settle the conflicts gradually arising from the contrast between positive and religious rights. The second part of the course will instead be dedicated more specifically to issues relating to the right not to carry out acts contrary to one's religious convictions. In particular, the role of women in the practice of female genital mutilation will be examined, the cultural / religious aspects that seem to justify its existence, cultural defense, the instruments adopted by international law and the various European and African state systems to combat this practice will be analyzed. controversial.
