Learning outcomes

The course aims to provide students with the tools necessary to achieve a comprehensive level of preparation on the most important principles and institutions of administrative law.

The teaching of Administrative Law deals with topics related to the objectives set by UNESCO in the doc. "Education to the Objectives for Sustainable Development".

Course contents

1. The sources of production of administrative law;

2. Administration and the Constitution. Constitutional principles on functions, organisation and action;

3. Organisation: administrative functions and public services;

4. Financial resources;

5. From function to action;

6. Administrative discretion;

7. Simplification and Administrative transparency (access and publicity);

8. Invalidity (nullity and voidability) and irregularities in administrative action;

9. Administrative proceedings at second instance;

10. The negotiating action of the Public Administration;

11. The protection of citizens against acts and behaviours of the administrations.

Teaching methods

Teaching will take place through lectures, which will be organized by the models decided by the DSG. Dialogue and interactions will be encouraged during class. Students will also be able to ask for additional questions or issues outside the hours of lectures, during the weekly office hours indicated at the bottom of this page.
In order to make the teaching activity more inclusive, during the course, meetings with qualified civil society actors will be organized in order to deepen methodologies and applications of the administrative law.

Within the course there is a specific module held by Prof. Massimo Calcagnile.

Supplementary Teaching
Attending students will be able to attend special seminars with practical exercises, involving the analysis of administrative measures and legal cases.
In order to better organize such seminars, the teacher will identify the subjects according to the specific interests of the class, which will be involved through a learning on demand teaching unit.

Visits to TAR and Corte dei conti will also be organised in order to provide studetes with the possibility to attend a Court hearing.

Assessment methods

Final exam will be held in oral form and the evaluation will be expressed out in thirty. The interview will focus on the topics indicated in the "Course contents" section, in order to verify the students' acquisition of the concepts taught within the course.

The student’s degree of preparation will be evaluated as follows:

if in favor of the candidate, the intermediate tests carried out during the year will be taken into account. It is not necessary to have taken/passed the intermediate tests to be present for the final exam.

Gradation of the final grade:

18-19 Very limiteted preparation. Basic answer to questions. Not very technical presentation

20-23 Discreet preparation. Accetable answer to questions. Exposure with elements of technicality.

24-27 Good preparation. Relevant answers. Technical and appropriate exposure.

28-29 Great preparation. Complete answers with exact terminology. Good ability exposure.

30 Excellent preparation. Answers supported by complete knowledge and with very appropriate terminology. Systematic exposure.

30 L Uncommon and excellent preparation. Very satisfying answers that denote study, indepth culture and acquired logical ability. Reconstructive and brillant exposure.

The final exam registration can only be made on-line on the University of Bologna web application.

Mid-term exam

Students attending classes will be able to take the mid-term exam.

Any further information regarding mid-term will only be provided in class.

Teaching tools

In order to facilitate the studying of the issues discussed during lectures and seminars, additional teaching materials will be given to students. This material will also be made available  on the Professor’s website and in the section of this page dedicated to educational materials.
