Learning outcomes

The course aims to analyse the European decision-making process and the main constitutional elements of the process of European integration, particularly with regard to the legal implications arising from it. At the end of the course, students will be able to understand the structural elements of the EU constitutional framework and their contextualization in the interaction between EU law and national law. At the end of the course students have developed the ability to analyse the main implications of the EU constitutional process, and to illustrate the main trends of the interplay between that process and the constitutional legal framework of the Member States.

Course contents

The Course aims to analyse the values, the principles and the fundamental rights of the European Union legal system, showing their reciprocal interactions and theur belonging to a single system.

To this aim, the relevant case-law of the Court coherent of Justice will be discussed, in interactive paritcipation with the students.

The course wil then take into exam the relationships between the Court of Justice and the national Constitutional Courts. Those relationships contribute to create a joint and shared consitutional model, and to contribute to promote a sared constitutional identity.

At the end of the course students are able to develop a critical analysis of the current constitutional dynamics at EU level
