Learning outcomes

Know the institutes of Roman commercial and maritime law, so as to be able to achieve a better understanding of the subsequent developments of the Roman tradition.

Course contents

1. Roman business law

Content, terminology and historical periods.
Introduction, terminological and method clarifications and periodization.

2. The commercial enterprise in Rome

Jurisdictional edicts and organization of commercial activities in Rome Birth and development of trade and the contribution of jurisdictional edicts. Slaves and freedmen as tools of the Roman entrepreneur.

3. Banks and bankers in Rome

Organizational tools and models.

Jurisdiction over bankers and the possibility to configure a "banking law"

Evolution of the banking organization in late antiquity

4. The shipping enterprise

Organizational models: individual and collective enterprise.

Types of contractual activities and responsibilities related to the operation of a shipping company

5. The enterprise of slave-traders

The edict of the curule aediles on the sale of slaves

Partial relevance of the societas venaliciaria towards third party creditors

Teaching methods

Lessons will consist of the methodical presentation and analysis of the topics, the examination, and discussion with students of legal and literary sources.

Assessment methods

The exam will be oral. For attending students, the learning assessment is foreseen in the discussion about topics covered by the course.

It is, however, possible to agree with the professor a different verification method.

The evaluation of the examination will be carried out taking into consideration:

- the knowledge of institutional profiles;

- the ability to analyze the sources visioned during the classwork;

- the ability to make connections among the different parts of the program;

- the ability to develop critical arguments;

- the articulation and the accuracy of the exposure.

By way of example, the following criteria will be used to assess the final mark (that will be out of 30/30):

  • sufficient or barely sufficient knowledge on the programme, poorly articulated or poorly cared for exposure → 18-21/30;
  • fairly good knowledge of the programme, good exposure → 22-25/30;
  • comprehensive knowledge of the programme, notable reasoning ability, curated and articulated exposure → 26-29/30;
  • extensive knowledge of the programme, very good reasoning ability; curated, articulated and critical exposure → 30-30L/30.

Please note that for the exam inscription, the student must have previously entered it in the study plan.
