Learning outcomes

At the end of the course a student will be familiar with the principles of different civil procedures and of Alternative Dispute Resolution methods Course contents

 

Course contents

The course will deal with the fundamental characteristics of Italian civil procedure, also with regard to Alternative Dispute Resolution methods (arbitration and mediation), tax trial and judicial actions presented to the Administrative Tribunal (TAR).

In this context the students will study about jurisdiction, court actions, evidence, pleadings and individual in the procedure ( i.e. Judge, Plaintiff and Defendant)

Moreover, the course will examine the constitutional principles on jurisdiction, judiciary system and advocacy, as well as general rules of law on civil procedure and tax trial.

Ordinary and summary trials, injunctions, interim measures and enforcement procedures will be also take into consideration.

Teaching methods

Lectures and seminars with help of slides.

Assessment methods

Oral examination lasting about 20/30 minutes, consisting of nos. 3/4 questions relating to the different types of procedural protection: declaratory, enforceable, protective, administrative and/or extrajudicial protection (mediation, conciliation, arbitration).

The vote is given in thirtieth according to the table below which illustrates the equivalence between the thirtieth marks and a judgment on the understanding of the subject matter derived from the examination test: (1) <18 insufficient; (2) 18-23 sufficient; (3) 24-27 good, (4) 28-30 excellent; and (5) 30 and excellent praise.
