Learning outcomes

At the end of the laboratory the student, thanks to the examination of practical cases, the analysis of jurisprudential decisions, the comparison with experts is able to have a practical approach to some contractual instruments used by economic operators.


Course contents

The topics covered during the Laboratory will concern in particular:

A) The contract in general:

• notion;

nomen iuris;

• Contractual freedom;

• Contract’s requirements: the agreement, the cause, the object and the form;

• the term and the condition;

• effectiveness;

• the nullity and voidability;

• interpretation and qualification;

• termination and withdrawal;

• the duty of good faith and abuse of the right.

B) Some individual contract:

• the private tender;

• the mandate;

• intermediation/brokerage, the agency, the procurement and reporting contracts;

• the social contract.

 


Readings/Bibliography

Lecture notes and contractual texts will be provided by the teacher to the Students.

 


Teaching methods

The verification of the knowledge acquired during the Laboratory will take place through a multiple-choice test possibly supported by an oral test.


 

Assessment methods

The teaching will be articulated both through lectures and through collegial analysis and evaluations of some practical cases through a systematic reading of the jurisprudential pronouncements of merit and legitimacy. The laboratory provides for an active participation of all students.

Teaching tools

During classes, material will be distributed by the teacher who will then have to analysed it in the light of precedent case law found directly by the Students and then discussed during the Laboratory.
