Learning outcomes

At the end of this course the student acquires knowledge about: - the role of the Public Administration involved in realizing/carrying out governmental (both local and national) projects; - the latter’s various articulations and applications, ranging from physical activities to sport activities to health.

Course contents

Prof. De Pamphilis module

In order to provide the student with the necessary skills to analyze problems and to structure the planning of activities concerning health and wellness, some fundamental institutions of private law will be illustrated (also through the comparison of legal systems and in the perspective of the harmonization of European law, as well as through a casuistic approach), such as:

  • Private law and its sources
  • Natural persons and personality rights
  • Legal persons
  • Property and rights on other's goods
  • The contract and representation
  • Coontract termination, invalidity, annulment
  • Tort law and civil liability

Prof. Pietrantonio module

Part 1)

  1. Rationale and characteristics of the legal norm in the modern legal systems.
  2. Difference between legal provision and substantive norm (example: art. 3 Italian Constitution).
  3. Organization of a modern legal system – who sets the rule and how?
  4. Sources of law – types of sources and relevant interaction.
  5. Enforcement of the legal norms and organization of the judicial system.

Part 2)

  1. Public administration (definition, typologies) and its functions.
  2. The importance of the European administrative law.
  3. The administrative procedure: decision-making process and applicable principles.
  4. The administrative decision. In particular: the decision to award a public contract/procurement.

    Part 3)

  1. The administrative activity aimed at awarding a public contract (history and evolution)
  1. National and European principles in the award of a public contract
  2. The procedure known as «public tender process» and the selection of the contractor
  3. The execution of a public contract
  4. Judicial protection

Prof. De Pamphilis module

During the lessons period, the professor will put at the students' disposal (also through his personal website) the teaching materials regarding each specific topic, which can be used for the exam preparation also by non attending students.

Prof. Pietrantonio module

Students will not be requested to work and prepare the final exam on a specific textbook but on the course slides, which will be made available on the platform.

Readings and bibliography are the same for attending and not attending students

Teaching methods

Prof. De Pamphilis module

The course is developed through classroom lectures, supported by the use of slides and the distribution of teaching materials.

Active participation of attending students is encouraged, also through a casuistic approach aimed at analyzing practical problems emerging in case law

Prof. Pietrantonio module

Classes are scheduled from October 7 to December 3, every Monday (room)

Assessment methods

At the end of the lesson period, students are allowed to take the final exam, through an interview

Prof. Pietrantonio module

The final evaluation will consist of a written exam. Due to the contingency situation the final exam will be carried out through four open question. The students will have 1 hour to deliver the text.

Teaching tools

The lessons will be accompanied by slides projection and the distribution of teaching materials.
