Learning outcomes

The course aims to provide the essential knowledge relating to the sources (national and community) of labour law; to the main problems in employment and organization of the labour market; to the discipline of safety and health at work, with regards to the various levels of responsibility. Students are expected to understand the role and the intertwining of the Community rules, the law, the collective bargaining and the relevant case law.

The program of lessons includes the following topics:

Part I:

The plurality of sources of matter.

The constitutional basis of the labour law.

Differentiation subordination/autonomy.

The powers of the employer.

Legal obligations upon the parties of the relationship.

Organization of the labour market and flexible contracts.

Company crisis.

Part II

Evolution of the regulatory system for the protection of safety at work: the Community sources and the general principles of risk prevention at work.

The Legislative Decree n. 81/2008 and subsequent amendments.

The employer, his collaborators, workers.

The obligations and the general measures on safety.

The delegation of functions.

The levels of responsibility and the article 2087 c.c.

For the analysis of some topics, other text references will be provided and additional materials distributed during the course.

As for the second part of the course students should consult the Legislative Decree n. 81/2008 and subsequent amendments and additions.

Teaching methods

Some lessons are held with the participation of students who will be asked to submit reports. Specialized material will be distributed to attending students also through the appropriate online support platform for teaching.

Assessment methods

The learning assessment takes place with an oral examination on the discussed topics during the course and indicated in the section "Program and contents".

The evaluation will be carried out taking into consideration the knowledge of the issues, the ability to analyze the jurisprudential and doctrinal theses, the ability to make connections between the different parts of the program, the ability to develop critical arguments, the articulation and accuracy of the exposure.

Attending is recommended and verified periodically by the professor.

Is also planned a middle test with regard to the first part of program.

The reports submitted by students during the lessons are evaluated.

Lessons will be held in the second semester and students can take the exam in the summer session.

In order to take the exam it is necessary to register with the appropriate list through Almaesami.

Thesis

The thesis will be assigned during an interview with the professor.

Teaching tools

Students who for reasons of disability or specific learning disabilities (DSA) need compensatory tools will communicate to the teacher their needs to agree on the adoption of the most appropriate measures.
