Learning outcomes

The course aims at conveying the basics on restorative justice from the theoretical and practical perspective.

 

Course contents

  • History and cultural foundations of Restorative Justice;
  • Contemporary accounts and different contexts of use;
  • The normative model: international and national legal sources;
  • The main characters: the victim; the perpetrator; the community; the facilitator;
  • Restorative processes and restorative outcomes;
  • Rights of the stakeholders and necessary information;
  • Restorative justice in the Italian system: a) juvenile justice; b) judge of peace; c) ordinary criminal trial; d) sentencing and execution;
  • Restorative justice and traditional penal system: antagonism and synergy. 

Readings/Bibliography

For attending students, the reading material will be provided by the teacher through Virtuale.

For non attending students, the textbook is

La disciplina organica della giustizia riparativa, a cura di A. Ceretti-C. Mazzucato-G. Mannozzi, Giappichelli, 2024.

Students are supposed to study parts I, II, III + chapter 1 ant 2 of part IV.

Teaching methods

The lecture will cover the entire program. The syllabus (assigned readings) and suggested readings will be made available through Virtuale.

At the end of the course, the teacher will hold a seminar on legal writing to prepare students for the redaction of the short essay (see: Assessment methods). 

Assessment methods

Attending students will be required to write a short essay (min. 2.500 words, footnotes excluded) on a topic that has to be previously agreed on with the teacher. 

Students will have to send the essay to the professor (at laura.bartoli2@unibo.it) at least 7 days before the exam day.

Erasmus students will have to write the essay in Italian; of course, the teacher will grade it keeping in mind that it was not written by a native speaker. 

In addition to the short essay, non-attending students will be interviewed on the fundamentals of the subject matter.

Students with learning disorders and/or temporary or permanent disabilities

Please contact the office responsible (https://site.unibo.it/studenti-con-disabilita-e-dsa/en/for-students) as soon as possible so that they can propose acceptable adjustments. The request for adaptation must be submitted in advance (15 days before the exam date) to the lecturer, who will assess the appropriateness of the adjustments, taking into account the teaching objectives.

The students will have the following tools at their disposal:

  • interactive hypertext supporting the writing seminar;
  • weekly simulations to prepare for the essay;
  • seminars;
  • laboratories with mediators.
