Learning outcomes
At the end of the course, students will: - have acquired specific knowledge of issues relating to judicial cooperation in civil matters within the European Union; - be able to address and resolve problems relating to the application of European legislation on jurisdiction and the recognition of decisions within the European area of justice; - learn and be able to use a transnational and multidisciplinary approach.
Course contents
The seminar will be held in the second semester, as part of the activities of the Jean Monnet Chair in European Judicial Cooperation.
It is conceptually linked (although independent) to the course on European judicial cooperation, exploring certain specific areas of judicial cooperation in the European space of justice.
In particular, these will be the topics examined:
- Jurisdiction and applicable law in the digital context, especially disputes involving influencers and online platforms.
- Habitual residence in family law, with an emphasis on cross-border parental responsibility and the Regulation (EU) 1111/2019.
- Cross-border insolvency, focusing on the concepts of COMI (centre of main interests) and secondary establishment, and on coordination between proceedings in different Member States.
- Discretion in the exercise of jurisdiction in parental responsibility matters.

Prof. Lupoi will indicate supplementary materials (articles and decisions) during the lessons.
Teaching methods
The workshop is eminently practical in nature, and, during the lessons, case-law will be discussed and hypothetical situations will be resolved interactively with the class.
Assessment methods
The final exam, for the purpose of obtaining certification for the seminar, will consist of a classroom discussion of a case provided by the teacher.
