Learning outcomes

In-depth knowledge of the general principles governing the judicial protection of rights and institutions of civil procedural law at first instance, with particular attention proceedings for the protection of claims at first instance and at the appeal level.

Assessment methods

The final exam aims to verify the achievement of the teaching objectives and the learning of the subject matter, namely civil procedural law.

Students may either:

- take exams for both DPC I and DPC II. The finals results of these two exams will be added up to achieve a single grade; or

- take a single exam for the whole DPC course, from the summer session of 2026 onward.

In any case, each exam will consist of a written test structured as follows:

Part I) Solution of a practical case in the form of an opinion (up to 10 points): duration 90 minutes. The use of the Civil Code and the Code of Civil Procedure (uncommented) is permitted.

Part II) two open-ended questions (up to 5 points for each question): duration 60 minutes. The use of codes is not permitted.

Part III) eleven multiple-choice questions (each correct answer is worth one point, there are no penalties for incorrect answers): duration 22 minutes. The use of codes is not permitted.

The results of the written test will be communicated within the following five days, with a notice published on Virtuale and on the WhatsApp group created by prof. Lupoi after the start of the lessons (to be added to the group, send a message to 349-5673931, specifying your name).

Within the following five days, students may send an email professor Lupoi to request an additional oral exam (at the next exam session)to improve their written exam result.

In the absence of such notification, the result of the written exam will be recorded.

Students with learning disorders and/or temporary or permanent disabilities: please contact the office responsible (https://site.unibo.it/studenti-con-disabilita-e-dsa/en/for-students) as soon as possible so that they can propose acceptable adjustments. The request for adaptation must be submitted in advance (15 days before the exam date) to the lecturer, who will assess the appropriateness of the adjustments, taking into account the teaching objectives.

Thesis: there are no waiting lists for the final dissertations. The title is decided together with the professor.

Teaching tools

In parallel with the lectures, there will be in-person exercises to prepare for the written exam, with self-correction by students following a description by the instructor of the optimal methods and content for completing the written response, with time for questions, further discussion, and requests for verification of any errors made.

In addition, a competitive Moot Court will be organized (participation is optional).
