Learning outcomes

Acquisition, at an in-depth level, of knowledge of the institutes of civil procedural law, with a focus on the process of cognition, the process of enforcement, special proceedings and arbitration, and with notions of judicial order and legal ethics.

Course contents

First semester: general principles; first instance proceedings and appeals.

During the first semester, professor Lupoi will hold a 20-hour module on European judicial cooperation as part of the activities of the Jean Monnet Chair on European judicial cooperation.

Second semester: enforcement, interim proceedings; national and European injunction proceedings; eviction proceedings; labor proceedings; proceedings in chambers and voluntary jurisdiction; recognition and enforcement of foreign judgments; arbitration and alternative dispute resolution methods in the domestic and European context, class actions.

Program for students who need to supplement their civil procedural law studies, having passed the Tutele giurisdizionali exam in the three-year degree program in G.i.p.a. (Ra) or the equivalent exam in the Corso di consulente del lavoro (Bo):

first instance proceedings (ordinary and simplified); appeals (general principles); types of appeals; enforcement, interim proceedings; national and European injunction proceedings; eviction proceedings, labor proceedings; proceedings in chambers and voluntary jurisdiction; recognition and enforcement of foreign judgments; arbitration and alternative methods of dispute resolution in the domestic and European context, class actions.

Master's degree students who have taken the complementary exam in General Procedural Law must bring the regular exam program

Teaching methods

The lessons will be theoretical in nature, with practical insights and classroom discussions.

Assessment methods

The final exam aims to verify the achievement of the teaching objectives and the learning of the subject matter, namely civil procedural law.

The final exam consists of a written test structured as follows:

Part I) Solution of a practical case in the form of an opinion (up to 10 points): duration 90 minutes. The use of the Civil Code and the Code of Civil Procedure (uncommented) is permitted.

Part II) two open-ended questions (up to 5 points for each question): duration 60 minutes. The use of codes is not permitted.

Part III) eleven multiple-choice questions (each correct answer is worth one point, there are no penalties for incorrect answers): duration 22 minutes. The use of codes is not permitted.

The results of the written test will be communicated within the following five days, with a notice published on Virtuale and on the WhatsApp group created by prof. Lupoi after the start of the lessons (to be added to the group, send a message to 349-5673931, specifying your name).

Within the following five days, students may send an email professor Lupoi to request an additional oral exam (at the next exam session)to improve their written exam result.

In the absence of such notification, the result of the written exam will be recorded.

The above exam procedure will also apply, starting from the summer exam sessions of the 2025/2026 academic year, to students who have failed exams in the 2024-2025 academic year and previous years.

Students with learning disorders and/or temporary or permanent disabilities: please contact the office responsible (https://site.unibo.it/studenti-con-disabilita-e-dsa/en/for-students) as soon as possible so that they can propose acceptable adjustments. The request for adaptation must be submitted in advance (15 days before the exam date) to the lecturer, who will assess the appropriateness of the adjustments, taking into account the teaching objectives.

Thesis: there are no waiting lists for the final dissertations. The title is decided together with the professor.

 

Teaching tools

In parallel with the lessons, one or more in-person exercises will be organised to prepare for the written exam, with self-correction by the students following a description by the teacher of the optimal methods and content for completing the written response, with space for questions, further discussion, and requests for verification of any errors made.

In addition, a competitive Moot Court will be organized alongside the lessons (optional participation).
