Learning outcomes

At the end of the course, the student: - possesses the fundamental concepts of the right to health and organisation of the National Health Service, with particular reference to personal services and those related to the sports sector; - possesses the fundamental concepts of the rules governing the provision of health services, also with reference to the division of competences between the State and the Regions in the field of sport and health; - is aware of the rights and duties that the State and CONI regulations attribute to athletes and sports clubs/associations in the field of health protection.

Course contents

The course aims to analyse and deepen the most significant aspects of the right to health in relation to sports practice and sporting events, considering the constitutional norms and principles on which the complex national and regional legislative framework is based, as well as the doctrinal developments and the jurisprudential dictates that have contributed to enrich the regulatory framework of reference.

Particular attention will be paid to the health service and to the system of health promotion through sports practice, to the athletes' health control system and to the anti-doping system, as well as to the division of institutional competences.

Policies, procedures and practices will be analysed.

Teaching methods

The didactics will be articulated in frontal lectures and collateral activities aimed at soliciting students' involvement.

In the lectures, the systematic exposition of the topics covered by the Course will be carried out according to the above-mentioned syllabus, followed by an examination of the individual topics addressed, also with regard to profiles in which the students have shown particular interest.

Assessment methods

The lectures will be held during the first semester. Therefore, students who obtain the attendance certificate will be allowed to take the final exam starting from the following January/February session.

Assessment
The final assessment consists of an oral examination.
The oral exam will cover topics related to those indicated in the section "Programme and Contents".

Evaluation of the exam will be based on the following criteria:

  • knowledge of institutional aspects;

  • ability to analyse doctrinal and case-law developments;

  • ability to make connections between the various parts of the course;

  • ability to develop critical arguments;

  • coherence and structure of the presentation;

  • accuracy and clarity of the exposition.

The expected learning outcomes will be assessed during the exam, which aims to verify the achievement of the educational objectives. The exam consists of an oral interview with the professor and academic staff, focused on the topics covered in the course.

The evaluation will consider the student’s understanding of institutional aspects, their ability to critically analyse doctrinal and jurisprudential positions, to make connections across the programme, and to formulate coherent and well-argued responses using appropriate legal terminology.

By way of general guidance, the final grade will be awarded according to the following criteria:

  • 18–21: Sufficient or slightly more than sufficient knowledge of the topics covered, limited critical thinking skills, difficulty in using technical-legal language;

  • 22–25: Fair to good knowledge of the topics, decent critical thinking skills, good use of technical-legal language;

  • 26–29: Good to very good knowledge, solid critical thinking skills, confident use of technical-legal language;

  • 30–30 with honours: Comprehensive and in-depth knowledge, excellent critical thinking, full command of technical-legal language.

Final Thesis
The final thesis is assigned upon formal request by the student (a dedicated email to the professor is sufficient) and following a personal interview.

As a general rule, the thesis is assigned based on chronological order of requests, considering also the student’s level of preparation, participation in the course, and demonstrated interest in the subject.

A copy of the thesis must be submitted to the professor at least one month prior to the scheduled date of the thesis defence.
