Learning outcomes
The course aims to provide a comprehensive overview of civil law institutions, enriched with extensive case law and jurisprudence, with a focus on EU law and comparative law.
Course contents
The aim of the course is to provide students with a comprehensive overview of obligations and contracts in the first semester and, in the second semester, to explore the civil liability system in greater depth, highlighting the role that flexible rules (e.g. fault, causality) and general clauses (e.g. unjust damage) have played in the current legal system.
The overall result is to provide students with a comprehensive overview of the system of obligations and contracts and a precise knowledge of the techniques of interpretation in the formation of current law, understood as living law.
Part I

§ the contract and private autonomy;
§ requirements;
§ validity and effects, including those of multilateral contracts;
§ termination.
Part II for attending students
· unlawful acts in the system of sources of obligations and the concept of civil liability;
· the concept of fact;
· the causal relationship and the rules for concurrence;
· negligence and intent;
· professional negligence;
· compensable damage;
· descriptive concepts of damage;
· the assessment and liquidation of damage;
· pecuniary damage to the person;
· biological damage and the new non-pecuniary damage;
· damage caused by bereavement.
Part II for non-attending students

§ strict liability;
§ unjust damage in history and today;

Students who have failed the exam must bring the programme for their year of study.
