Learning outcomes

At the end of the lessons the student:

- knows the cultural roots and the technical characters which identifie Modern and Contemporary Age on the side of legal history

- knows the crisis of the ius commune system; knows the legal Enlightment; knows the costitutionalism and the age of Codification in western continental Europe

- will know, in advance, two reality concerning civil law - inside property and law of person and family -. They will be explained like examples in an ideal historical joureny.

Course contents

Basic part

The Age of late ius commune - Legal science in Europe in 1600/1700th - The innovations of Ancien Régime - from Enlightment to Codifications - Right and Laws during and after the French Revolution - The Codes of Napoleon and their reception in Italy- The society of the Civil Code - ABGB (1812) - Legal science and Codes after 1815 - From the Unity to the First World War (1865-1945) - The Age of Fascism

Teaching methods

The lessons of Modern and Contemporary Legal History last the all year.

The first step, before Christmas holidays, is opened by Prof. Nicoletta Sarti and includes a didactical intert of 20 hours of prof. Andrea Padovani.ù

The second step is emder the scientific leading of prof. Marco Cavina.

Assessment methods

The final examination wants to certifie that the student

- knows the cultural roots and the technical characters which identifie Modern and Contemporary Age

- knows characters and problems which link the Age of ius commune to the Age of Codification.

 

Teaching tools

The lessons will be supported by proiection of slides and digital texts.
