Learning outcomes

The expected learning outcomes of the course are the knowledge of the structure of the criminal process and the understanding of its fundamental priciples, as well as the achievement of a basic expertise on the rules of procedure and evidence, as it is needed for legal practice.

Course contents

Penal jurisdiction - Constitutional principles and "fair trial" - Accusatorial and inquisitorial system - Persons and deeds - The dynamics of the ordinary proceedings from the reports of crime to the first degree judgment - Special proceedings - Evidence - Precautionary measures - Appeals - Final decision.

AA. VV. (a cura di G. CONSO e V. GREVI), Compendio di procedura penale, quinta edizione, Cedam, Padova, 2010 (up to chapter X, paragraph 5 included). It is necessary to use the latest edition available of the Code of criminal procedure, to be updated with any subsequent amendment.

Assessment methods

The course lasts for the entire year, therefore those who get the attendance certificate in the current academic year can take the exam only from May onwards. The exam will be only oral.

Propaedeutic

It is strongly recommended to take the exam only after passing the exams of Diritto penale and Diritto processuale civile.
