Learning outcomes

Philosophy of law from a normative point of view. The concept of law, human rights, democracy are keywords of the course.

Course contents

The law and Its Shadow. On the Sense of Punishment

The course will deal with the judicial declination of the concept of democratic law, which emerged and recounted in the first module, following its historical genesis and twentieth-century theoretical elaboration.

At the center will now be the punishment, its meaning, its most extreme manifestations (such as the death penalty or life imprisonment), the ways of its infliction (starting with the prison institution), the abuses, like inhumane practices such as torture. The theoretical framework of the different conceptions of punishment will be reconstructed; they will be observed in relation to the democratic paradigm and, in the final part of the Course, they will be looked at investigating the roots of violence in society.

The landing of the unitary path faced from week to week will finally be the identification of the cultural dynamics and the logic of power (in particular the relationship between childhood and crime) which constitute one of the most relevant factors in affirming the "reverse of vita activa" and in the diffusion of individual actions that lead to multiple expressions of its denial.
