Learning outcomes

The acquisition and deepening of issues regarding constitutional guarantees in the criminal system; the learning of the outlines of general theory of crime and punishment, as well as the structure of the main penal institutions with reference to the general part of the code. The examination of the special part of the penal code and the main issues related to complementary criminal legislation.

Course contents

The course aims, first and foremost, to illustrate the nature and purposes of criminal law as well as the relationship between the criminal system and the Constitution. Specifically, it will address: the structure of the offence in its various elements, the forms of manifestation, and the sanctioning system. The relationships between the general part and the special part will also be analysed in class, as well as the main types of offences belonging to the latter.


For incoming students, the programme for the general part and special part coincides with that of Unibo students.

Teaching methods

The teaching that takes place in the classroom aims to create a learning environment conducive to a flexible relational style. Various methodologies may be adopted, depending on the topic addressed or the stimuli from the students. For example: cooperative learning, role-playing, flipped classroom.


There will also be a practical approach during certain case studies, in which to verify the knowledge, as well as the skills and competences acquired regarding the general provisions and the criminal offences referred to therein.


Attendance at lessons is optional. However, for students who intend to take the ongoing assessment, namely in the winter session, participation is mandatory.

Assessment methods

In parallel to the lessons, one or more in-person exercises will take place, lasting approximately 2 hours, consisting of a brief illustration of a topic by the instructor and the administration to the students of an open-ended question, followed by the students drafting a written text according to the previously outlined instructions (within the time limits and according to the length indicated by the exercise coordinator), and finally, self-correction by the students after the instructor describes the optimal methods and content for developing the written response, allowing space for students to ask questions, seek clarifications, or verify any mistakes made.


The final exam consists of an oral interview covering both the general and special parts of criminal law.


Students with Specific Learning Difficulties (SLD) or temporary or permanent disabilities: it is recommended to contact the responsible university office in advance (https://site.unibo.it/studenti-con-disabilita-e-dsa/it): it will be their responsibility to propose any adjustments to the interested students, which must be submitted for the instructor's approval at least 15 days in advance, who will assess their appropriateness in relation to the educational objectives of the course.


The oral interview aims to evaluate the critical and methodological skills developed by the student, who will be invited to engage with the main themes addressed during the course (principle of legality, general theory of crime, sanctions system, main incriminating cases analysed in the recommended texts).


The student's ability to navigate the normative sources and the main interpretative directions (doctrinal and jurisprudential) referenced in the recommended texts for exam preparation will be particularly appreciated.


Preparation on a very limited number of topics covered in the course and analysis skills that emerge only with the help of the instructor, expression in generally correct language → 18-19; Preparation on a limited number of topics covered in the course and independent analytical skills only on purely executive issues, expression in correct language → 20-24; Preparation on a wide range of topics covered in the course, ability to make independent critical analytical choices, mastery of specific terminology → 25-29; Substantially exhaustive preparation on the topics covered in the course, ability to make independent critical analytical choices and connections, full mastery of specific terminology and ability to argue and self-reflect → 30-30L.
