Learning outcomes
Learning objectives This course illustrates the essential lines of corporate criminal liability, pursuant to d. lgs. 231/2001. Since business activitiy is carried out mostly by subjects structured in corporate form, it is of prominent interest to understand how corporations are held liable for crimes committed by natural persons it employs, insomuch as the corporation and the natural person could be both liable. During the course, the most common predicate offences in business activity are analyzed, like corporate crimes, money laudering, or criminal negligence related with non-compliance with workplace safety regulations, as well as corporate crimes consisting of deviant acts in the relations with the public administration (also included in d. lgs. 231/2001), like, in the first place, corruption.
Course contents
The general criteria for ascribing criminal liability to the entity;
The position of apical subjects;
The position of persons subject to the direction of others;
The penalties that can be imposed on the entity;
Corporate offenses;
Money laundering;
Manslaughter and serious or very serious injury committed in violation of the rules on protection and safety at work;
