Learning outcomes


The course is aimed at providing the students with the knowledge of the main topics of administrative law, in the framework of the innovation process which involved the public administration, with the aim of improving the quality of the relationship with the citizens, by semplifying and modernizing the administration’s language. Lectures will be provided.
Students will have to demonstrate to have acquired knowledge about the evolution of relationships between public administration and citizen and, more generally, a critical understanding of the topics.
The ability of the reconstruction and interpretation of the topics analyzed will be enhanced; Case studies will allow the study of specific topics covered by recent regulatory changes and case-law

Course contents

 

The contents of lessons will be defined on basis of the knowledge already acquired by attending students. Students who cannot attend are invited to contact the teacher (silvia.nicodemo2@unibo.it). The course aims - within the limits of the hours available and compatibly with the composition of the class - to provide the basic notions of administrative law in consideration of the digitalization process.

Public administration and administrative law; The general principles of administrative law; Public communication: effectiveness and transparency of administrative action; The sources of administrative law with particular regard to European law; -Public resources and public expenditure - the public budget and central and local administrative action- PNRR Administrative bodies; - Public functions and public services; Regulation and competition; - Public employment and public management; Discretionary and bound activity of public administration; - Administrative proceedings and access to administrative documents; - Validity and legal effects of public measures; - Consensual activity performed by public bodies; Public contracts; - Public liability; - Principal outlines of the administrative justice system.

Teaching methods

In addition to lectures, case studies will allow the study of specific topics covered by recent regulatory changes and case-law.

Innovation in teaching and learning:

in relation to the composition of the class, the following activities will be proposed:

- Consulting databases by accessing institutional websites

- Consultations sources of law and sources for research

- Enhancement of methodological aspects in the study, interpretation and application of administrative law

- Enhancement of written processing -papers - individual or group study activities to be reported in the classroom

- group work and class discussions.

Assessment methods

The final exam will be held in oral form, and will cover the topics indicated in the program

By way of example, the following criteria will be used to assign the final mark (that will be out of 30/30):

- knowledge of a very limited number of topics, extensive support by the interviewer to address and answer the questions, basic yet appropriate language  18-19/30;

- knowledge of a limited number of topics, ability to autonomously address basic legal problems, use of appropriate language → 20-24/30;

- comprehensive knowledge of the programme, ability to autonomously and critically analyse legal problems, use of specific terminology → 25-29/30;

- extensive knowledge of the programme, ability to reason autonomously and critically analyse legal problems, make connections between the topics, ability to master the specific terminology and ability to present legal arguments. → 30-30L/30.

To attend the exam, each student must sign up via AlmaEsami within the deadline. Those who cannot sign up must immediately (before the official closing of the subscription lists) communicate the problem to the teaching secretariat. Deciding whether to allow not enrolled students to attend the exam or not is up to the teacher.

ATTENDING STUDENTS
During the course the attending students will participate in activities on the topics discussed in the lessons, the outcome of which will be taken into account for the purposes of the final exam. In particular, for attending students there is the possibility to agree on a different examination method.
