Course contents

The course wants to explore the following issues:

I) The foundation of rights. Dignity and rights. The conceptions of rights in the different cultural traditions.

II) The establishment of modern international law and the concept of the law of the peoples (sec. XVI-XVII). F. de Vitoria, F. Vasquez de Menchaca, U. Grozio.

III) The international law in the 19th century. The international law as an "European "law of the "civilized" peoples. The international "European" law as a "Christian" law. The opposition with the Islamic international law ("siyar") and civilisation.

IV) From the concept of "civilisation" to the idea of "development". The plurality of legal framework. The debate between civilisations in the contemporary international. To a new law of the peoples?

V) International law and the Third World : the contemporary aspect of the Western colonialism.

VI) The clash of civilisations and the mediterranean alternative.

VII) The international criminal law and the different conceptions of the war ( humanitarian war, right war, illegal war) .

VIII) Terrorism and the new world order.

Assessment methods

A) For the students of the graduate course on "Cooperazione internazionale, tutela dei diritti umani e dei beni etno-culturali nel Mediterraneo e in Eurasia" the course is of 9 credits (CFU).

The frequenting students will take an oral exam based on 3 texts by choice among the above cited textbooks .

The not-frequenting students will take an oral exam based on 4 texts by choice among the above cited textbooks. One of the three texts should be G. Gozzi e G. Bongiovanni, Popoli e Civiltà. Per una storia e filosofia del diritto internazionale , Il Mulino, Bologna 2006.

B) For the students of the graduate course on "Culture e diritti umani" the course is of 9 credits (CFU).

The frequenting students will take an oral exam based on the textbook: G. Gozzi e G. Bongiovanni, Popoli e Civiltà. Per una storia e filosofia del diritto internazionale , Il Mulino, Bologna 2006, and on 2 other texts by choice among the above cited textbooks.

The not-frequenting students will take an oral exam based on the textbook: G. Gozzi e G. Bongiovanni, Popoli e Civiltà. Per una storia e filosofia del diritto internazionale , Il Mulino, Bologna 2006, and on 3 other texts by choice among the above cited textbooks.
