Learning outcomes

At the end of the course the student: - possesses the basic concepts with regard to the employment relationships in the sports sector - is able to apply this knowledge to the sports employment contract, with an in-depth analysis of the actions to protect related rights - is able to understand the case law examined on these issues.


Course contents

The course aims at clarifying the most relevant elements concerning the employment relationship in the sport sector, also with a case-by-case approach.

The course will focus on the main theoretical and practical-applicative issues concerning sport employment relationships, both in the professional and amateur sectors, starting from Law no. 91/1981 and paying particular attention to the solutions adopted by the 2021 reform. In particular, the topics addressed will be the following:
1. The relationships between the sports system and the state system.
2. Law no. 91/1981 on professional sport and the fiscal and social security legislation for amateur sector.
3. The constitutional framework and ordinary legislation.
4. Legislative Decree no. 36/2021:
a. the notion of sport;
b. the notion of sports worker;
c. contractual types: subordinate employment contract and self-employment contract;
d. applicable law;
e. social security protections. 

Readings/Bibliography

During the first lessons, the teaching materials necessary for the preparation of the exam will be provided and and uploaded on the University's platform “Virtuale”.

Non-attending students will have to prepare the final exam on the following book: C. DI MATTIA, Il rapporto di lavoro sportivo. La riforma del lavoro sportivo aggiornata al "Decreto correttivo-bis" (d.lgs. n. 120/2023), Giuffrè, Milano, 2023. 

The book must be studied from page 1 to page 180 ("La disciplina dei rapporti di lavoro di carattere amministrativo-gestionale") 

Teaching methods

The lessons will be held by the course teacher and will take place in the second semester.

The course will be divided in front lessons  and discussion sessions between the teacher and the students, to encourage the involvement and active participation of all students.
Given the Course's focus, active participation is particularly important for a thorough understanding of the legal principles.

 

Assessment methods

The exam will be conducted through an oral interview, aimed at verifying the acquisition of knowledge, and will consist of multiple questions concerning the aforementioned program (section "Course contents").

The evaluation of the exam will take into account:

- knowledge of institutional profiles;

- the ability to make connections between the different parts of the program;

- the ability to develop critical arguments;

- the articulation and accuracy of the exposure.

In particular:

- knowledge of a very limited number of topics covered in the course and analytical ability that emerges only with the help of the teacher, expressed with generally correct language: 18-19;

- knowledge of a limited number of topics covered in the course and independent analytical ability only on purely executive issues, expressed with correct language: 20-24;

- Knowledge of a wide range of topics covered in the course, ability to make autonomous choices of critical analysis and connections, mastery of specific terminology: 25-29;

- Substantially exhaustive knowledge of the topics covered in the course, ability to make autonomous choices of critical analysis and connections, full mastery of specific terminology and ability to argue and self-reflect: 30-30L.

Teaching tools

The lectures will be in the forms prescribed by the Department.

The materials will be uploaded to the University's platform “Virtuale”.

Students who, due to disabilities or specific learning disorders (DSA), need compensatory or alternative tools, can communicate their needs to the Teacher in order to agree on the most appropriate measures.
