Course contents

The course is organized in two phases. The first is dedicated to the acquisition of the meaning, the essence and the main institutions of the criminal law and has a preparatory function necessarily with respect to the second phase. The second part of the course analyzes the essential contents of the penal provisions relating to employment with particular emphasis on theoretical and interpretativelines and most relevant criminal offenses.

Parte IV (Le forme di manifestazione del reato): In the cap. II (circostanze del reato), are excluded parr. 7,8,9,10,11,12;13.

In Capitolo IV (Concorso di persone nel reato) are excluded the parr.  6,7,8,9,   e poi 11, 12, 13, 14, 15, 16, ) Must be studied  par. 10 (Reato diverso da quello voluto da taluno dei concorrenti); is excluded the Capitolo V (Unità e pluralità di reati).

Parte V (Pene, punibilità e misure di sicurezza):in the cap. II  (Le pene principali) are excluded the parr. 7, 8; is excluded all cap. III (Le pene accessorie); is excluded all Cap. IV (la commisurazione della pena);in the  Cap.V, (Le vicende della punibilità) are excluded the "cause di estinzione del reato e della pena" (from par.5) must be studied "l'oblazione" (par.13). In the cap.VI (Le misure di sicurezza) are excluded the parr. 7, 8. Is excluded the Cap.VII (Conseguenze civili del reato).

Teaching methods

Lessons lectures with significant judicial examination of cases

Assessment methods

Profit exam will take place in oral form. The interview will focus on the topics indicated in the "Program and contents" section.

The evaluation of the test will be carried out taking into consideration:

knowledge of institutional profiles;

the ability to analyze the jurisprudential and doctrinal guidelines;

the ability to make connections between the different parts of the program;

the articulation and accuracy of the exposure.

By way of example, the following criteria will be used to assign the final mark (that will be out of 30/30):

· knowledge of a very limited number of topics, extensive support by the interviewer to address and answer the questions, basic yet appropriate language à 18-19/30;

· knowledge of a limited number of topics, ability to autonomously address basic legal problems, use of appropriate language → 20-24/30;

· comprehensive knowledge of the programme, ability to autonomously and critically analyse legal problems, use of specific terminology → 25-29/30;

· extensive knowledge of the programme, ability to reason autonomously and critically analyse legal problems, make connections between the topics, ability to master the specific terminology and ability to present legal arguments. → 30-30L/30.

Teaching tools

Students must be in possession of a penal code with complementary legislation even during class time
