35648 - Civil Procedure Law and French Judicial Organization

Learning outcomes

The course aims to make students familiar with the basic aspects and institutions of civil procedural law.

Course contents

The course includes eight units:

a)      Principles and basic concepts of civil procedural law;

b)      First instance proceedings;

c)      Appeals;

d)      Enforcement;

e)      Interim, special and summary proceedings;

f)        Labour law proceedings;

g)      Arbitration;

h)      European law on civil procedure.

 

Unit g) is not compulsory for students who include the “Internal and international arbitration law” module in their study plan, or have already passed the examination in the same module.

 

Unit h) is not compulsory for students who include the “European Union procedural law” module in their study plan, or have already passed the examination in the same module.

 

For Socrates/Erasmus students the program is detailed in the paragraph “texts”.

 

For French students of the University of Nanterre attending the third year in Bologna, the program includes:

a)      Principles and basic concepts of civil procedural law;

b)      First instance proceedings;

c)      Appeals;

d)      European law in matter of civil procedure.

 

For Italian students attending the module “Diritto processuale civile e ordinamento giudiziario francese”, the program for the part of “Diritto processuale civile” includes:

a)      Principles and basic concepts of civil procedural law;

b)      First instance proceedings;

c)      Appeals;

d)      European law in matter of civil procedure.

G.F. RICCI, Diritto processuale civile, 4th edition, Giappichelli, 2012, vol. I, II and III (this one only on pp. 1-272, 283-314, 381-505) (1082 pages)

 

b) One of the following texts, at student's choice:

BIAVATI-LUPOI, Regole europee e giustizia civile, 2nd edition, Bononia University Press, 2013. In this book, chapters by Biavati, Lupoi and Porcelli are mandatory; other three chapters should be chosen among the remaining ones  (160 pages about)

or

CAVALLINI, (ed.), Argomenti di ordinamento giudiziario, Bononia University Press, 2013 (160 pages).

 

Socrates/Erasmus students programs depend on the needed number of credits. Unless otherwise specified, the program includes:

b) BIAVATI-LUPOI, Regole europee e giustizia civile, 2nd edition, Bononia University Press, 2013 (160 pages).

 

Graduate students of the “Corso di Laurea in Operatore giuridico d'impresa” di Ravenna, must first take an additional exam (3 credits) by preparing one of the following texts: BIAVATI, Argomenti di diritto processuale civile, 2nd edition, pp 277-525, or G.F. RICCI, Diritto processuale civile, 4th edition, vol. II.

 

For French students of the University of Nanterre attending the third year in Bologna the following texts are recommended:

For Italian students attending the course “Diritto processuale civile e ordinamento giudiziario francese” the following texts are recommended:

Teaching methods

Classes will be taught in the first and in the second semester. Students attending the course in 2013/2014 will be allowed to take the exam from May 2014.

French students of the University of Nanterre attending the third year in Bologna are required to attend only first semester classes, and are allowed to take the exam from January 2014.

Assessment methods

The oral exam is aimed at verifying the knowledge of the subject, the use of the correct terminology and the problem solving ability.
