Course contents

We shall analyze the level of coordination of the legal systems of the countries in the Eastern Europe and the "unifying" role played by Soviet law. We shall analize the transition from the Roman-Germanic law to Roman law after the regime change occurred with the 1989/91, given the reference models hired to reform the legal system. We shall rebuild the framework provided by the Helsinki Conference, highlightening the role played by the Council of Europe through the work of the Venice Commission, as well as the reference points set up by the nascent European Union law, in light of the jurisprudence of the ECHR , in order to understand the current constitutional framework of the different states, with particular attention to the protection of the human rights and religious freedom.

Articles, essays, as well as regulatory measures, aimed at preparing the exam will be provided by the teacher.

Teaching methods

Teaching will be interdisciplinary and involves the participation of other teachers in relation to topics discussed. The seminar includes the lectures, the use of materials on the site http://licodu.cois.it, the creation of synoptic tables on the measures treated, the drafting of a report on one of the themes indicated during the course, with particular attention to the work of the Venice Commission.
Notions will be provided for the preparation of bibliographical notes.

Assessment methods

Credits will be awarded after a discussion of the report and an oral examination about the subjects covered.
The frequency to the 2/3 of the lectures is mandatory.
