Learning outcomes

The course of criminal labor law arises among its objectives the analysis of the profiles, general and special, that characterize the discipline: first, the root of constitutional criminal law protection of the interests involved. The knowledge of the system formed by d.lgs. n.626/1994 and subsequent decrees. The problem of the guarantors and the transfer of criminal responsibility in the light of recent legislation. The standards of safety and technological progress. The criminal liability relating to the recruitment of foreign workers.

Course contents

The main training objective concerns the institutional issues of criminal labor law and in particular those related to safety and hygiene at work. Constitutional principles and criminal labor law. Connections and autonomy with respect to the general part of criminal law. The contract of employment and job security, the mechanism of extinction of fines. Regulatory developments in the field of safety and health at work, the preventive health protection of workers in the Penal Code: articles 437, 589, 590 and 451, the guarantor of the safety of workers, the case studies in the field of asbestos's time consummation of the occupational disease; blame; Article. 2087 cc, the employer definition, the head of the production unit, the delegation of functions: value and character; executives; those in charge, the position of the worker, the administrative liability of legal entities for injuries on the job.

Lectures and analysis of case law.

Assessment methods

The exam will be oral, through the analysis of some of the issues that are part of the program. For attending the first question will focus on the subject that has been treated by them in class in the form of oral dissertation. The second question will cover a topic of general part or special part, at the option of the student. For not attending the first application relating to profiles of a constitutional matter, and the second aspects of the general part of criminal law and the third (which is accessed only if the previous has been answered at least sufficient)'ll have a profile of special part.
