Seminar Legal Reasoning in Private law - Examination (Winter session 2023-2024)

Students shall write a text according to the following instructions and send it to Prof. Marco Martino (m.martino@unibo.it) and Prof. James Gordley (jgordley@tulane.edu) no later than 4 (four) days before the day of the examination (to be booked according to the usual procedure).

The exam in person will only consist of the registration of the assigned mark, if not refused (non-attending the exam shall be considered as a refusal).

So, e.g.: if one wants to take the examination and she writes the essay and submits it before January, 20th, then she can book the exam on January 24th.

Please check available dates (currently: January 10th, 24th, February 5th) and book your exam in advance.

 

ESSAY (only valid for the current examination Winter Session January-February 2024):

 

Write an essay of no more than three pages single-spaced on EITHER of the following topics.

I. The influence of changes in the accepted methods of legal reasoning on EITHER of the following doctrines:

a. consent in the formation of contracts OR

b. relief for an unfair price.

II. The methods of legal reasoning of EITHER

a. the medieval jurists and the late scholastics OR

b. the late scholastics and the nineteenth-century conceptualists and positivists.
