The Seed Funding Project “WHC@50 – Forever Young: Celebrating 50 Years of the World Heritage Convention” involves four Una Europa Universities (University of Edinburgh, KU Leuven, Universidad Complutense de Madrid, and Alma Mater Studiorum – Università di Bologna as project coordinator).

Theme and goals of the Seed Funding Project WHC@50

In 2022 the World Heritage Convention (WHC) celebrates 50 years. Thanks to its 194 State Parties, the WHC represents a major tool for International (Cultural Heritage) Law, a powerful promotor of cultural identity, and a formidable boost for national economies.

The Una Europa Seed Funding Project “WHC@50” aims to retrace how the WHC was conceived, to present its current formulation and application in practice, to illustrate its meaning for the preservation and enhancement of world heritage governance, to analyse its strenghts and weaknesses, and to indicate its needs for reviews and reforms.

By combining the insights of jurists, political scientists, historians, architects and economists, WHC@50 embarks on a multi-perspective analysis that will result in a high-quality open access publication.

Abstract [En]: Since May 2016, the United States of America has been vetoing the selection of the members of the WTO Appellate Body, alleging procedural and substantive criticisms on the activity of the Standing Tribunal. Consequently, at midnight of 10 December 2019 the World Trade Court ceased to be operational, as only Zhao Hong, the Chinese judge, remained in office. Faced with such an unprecedented WTO institutional crisis, the EU has chosen to be a major actor in the reform process of the multilateral appellate review mechanism. Beyond presenting important institutional proposals to amend Article 17 of the DSU, which have been highly considered in the Walker Principles, the EU launched a very interesting temporary solution to preserve appeals in Geneva, the Multi-Party Interim Appeal Arbitration Arrangement (MPIA), which is based on the autonomous alternative dispute settlement means already referred to in Article 25 of the DSU. After the consideration of the features of this provision, the present article analyses how the EU suggested, developed, and progressively gained support for its MPIA project within the WTO community, illustrating the main aspects of the temporary appeals arbitration arrangement and taking into account the objections the US started to raise against some aspects of the important interim procedure.

Abstract [It]: Dal maggio 2016, gli Stati Uniti d’America hanno posto il veto all’elezione dei membri dell’Organo d’appello dell’OMC, sollevando critiche di natura procedurale e sostanziale rispetto all’attività di tale Tribunale permanente.

<a10:updated>2020-07-23T11:21:19+02:00</a10:updated>

The EU Approach to Overcome the WTO Dispute Settlement Vacuum: Article 25 DSU Interim Appeal Arbitration as a Bridge Between Renovation and Innovation

At midnight of 10 December 2019, the WTO Appellate Body ceased to be operational, as the US has been vetoing since May 2016 the selection of the members of the World Trade Court. The WTO dispute settlement system hence risks paralysis - a scenario occurring in case the losing party of a panel report appeals the latter “into the void,” i.e. before an Appellate Body with less than three judges. In response to this event, the European Union is developing an articulated approach to guarantee a rules-based international trade system and the principle of cooperation as the pillars of the governance of the global economy. One element of the EU approach is an initiative for an interim appeal arbitration procedure based on Article 25 of the DSU. The present work is devoted to the analysis of such a contingency measure, which may represent a bridge between the renovation of the existing multilateral dispute settlement mechanism and the innovation of a new two-level international judgment mechanism for settling trade controversies.

The WTO dispute settlement system hence risks the paralysis -a scenario that could materialize should the losing party of a panel report appeal the latter “into the void,” i.e. before an Appellate Body with less than three judges. In response to this event, the European Union is developing an articulated approach to guarantee a rule-based international trade system and the principle of cooperation as the pillars of the governance of the global economy. One element of the EU approach is the initiative for an interim appeal arbitration procedure based on Article 25 of the DSU, and the present work is devoted to the analysis of this contingency remedy.

Title: A WTO safe harbour for the dolphins : the second compliance proceedings in the US – Tuna II (Mexico) case Author: BARONCINI, Elisa [https://cadmus.eui.eu/browse?type=authoramp;authority=5f34bc2b-d70c-4226-a0a5-b917d6e9a17e] ; BRUNEL, Claire [https://cadmus.eui.eu/browse?type=authoramp;authority=9e68cd14-b5f6-4aa9-98ab-cde9fedc819d] Date: 2019 Publisher: European University Institute Series/Number: EUI RSCAS; 2019/75; Global Governance Programme-365; [Global Economics] URI: http://hdl.handle.net/1814/64487 ISSN: 1028-3625 Abstract: Subsequent to the 2016 modifications concerning the strengthening of the administrative requirements on dolphin-safety outside the ETP fishery zone, the second WTO compliance proceedings has finally found the US Dolphin-Safe labelling scheme compatible with the multilateral trade system. We provide an overview of the long running US-Mexico dispute and assess the final findings of the WTO adjudicators attempting to determine the effects of the multilateral litigation on the involved non-trade values and the real winners of the case. We find an improvement in dolphin protection, though more could be achieved through a qualification of the US measure under the principle of sustainable development also contemplated in the Preamble of the WTO Agreement, as well as an enhancement on consumer information, since declaration of dolphin-safety may now be better monitored and enforced through the new discipline for non-Eastern Tropical Pacific Ocean tuna products. However, we also observe that with no change to the appearance of the label or an informational campaign, the improved credibility of the label may hardly be passed-through to the average consumer. Furthermore, despite an increase in the stringency of the regulation for their competitors, Mexican producers do not gain greater access to the US and instead have been diversifying towards other markets. We then highlight that the Appellate Body missed an opportunity to reinforce the transparency of the system by supporting the first-ever decision to grant partially open panel meetings.

undertakes a yearly analysis of all case law by the adjudicating bodies of the WTO (un-appealed Panel reports as well as Appellate Body reports). The Reporters Studies for 2018 will cover a wide range of WTO law, ranging from classic trade in goods issues to trade in services. Each of the cases is jointly evaluated by an economist and a lawyer, both well-known experts in the field of trade law and international economics. The Reporters critically review the jurisprudence of WTO adjudicating bodies and evaluate whether the ruling makes sense from an economic as well as legal point of view, and if not, whether the problem lies in the interpretation of the law or the law itself. The Studies do not always cover all issues discussed in a case, but they seek to discuss both the procedural and the substantive issues that form the core of the dispute.

Abstract

Within the EGP Project ldquo; The Capacity Building of Environmental Justice and Guarding Environmental Rights in Western Chinardquo;, the scholars of the University of Bologna, partner of the China University of Political Science and Law (CUPL) and its Center for Legal Assistance to Pollution Victims (CLAPV), have worked on an Environmental Law Survey so as to provide to the interested public ndash;in particular, Chinese judges, lawyers, academics, and civil society as a whole ndash; with the most interesting and recent judicial decisions or pieces of Environmental Law legislations developed in the most relevant legal fields. The choice has fallen on the scientific juridical disciplines of Administrative Law, Comparative Law, Criminal Law, EU Law and International Law (the latter with a particular focus on the case-law of the European Court of Human Rights in Strasbourg), since these express highly relevant perspectives for the promotion of an effective environmental protection within the European Union, European Countries, and the International Community. We hope that the carefully selected rulings and pieces of legislation may provide the Chinese interpreter, practitioner or judge involved in Environmental Law issues in China or concerning China with legal reasoning and innovative juridical solutions which may inspire their extremely demanding daily activities, constantly involving a balance between the right to a clean and healthy environment of the citizens and the rights of economic operators and undertakings.
Presentazione

<a10:updated>2013-02-06T15:30:05+01:00</a10:updated>
