Learning outcomes

At the end of the course the student knows the main features of the intellectual property right at national and European legal level. The student also knows how to make a critical reading of the jurisprudential guidelines and has acquired the tools to update his own training independently

Course contents

1. National and European regulations concerning: unfair competition, unfair commercial practices, distinctive signs, inventions and models (with particular reference to patent protection), copyright.

2. Internet-related goods and related legal regulations are also considered (eg: protection of software and databases, use of metatags in competitive dynamics, regulation of domain names, protection of digital works, etc.).

Readings/Bibliography

1) Vanzetti-Di Cataldo, Manuale di diritto industriale, Milan, Giuffrè, latest edition (Parts 1, 2 and 3, with the exclusion of Parts Nos. 4 and 5);

2) selection of case law and scientific articles related to issues concerning new technologies (they will be loaded between the teaching materials available online or indicated on this page, before the start of the course)

Teaching methods

The course is divided into lectures, in which the teacher will illustrate the fundamental legal principles of the subject, also commenting on relevant legislation and jurisprudence.

Assessment methods

The exam will be held in oral form.

Only students attending are allowed to deepen a theme agreed upon with the teacher, which will be carried out in the form of a thesis and then also presented orally (with the possible help of slides). This optional activity will be evaluated and will contribute to the assignment of the final vote.

As for the gradation of the vote, expressed out of thirty, the following general criteria are used: Insufficient: 0-17 Insufficient and inadequate knowledge of the topics contained in the program, gaps in the program, overall incorrect language Sufficient: 18-20 Sufficient knowledge of the topics contained in the program and overall correct language Fair: 21-23 Fair knowledge of the topics contained in the program, fair ability to deepen and analyze some specific parts, overall correct language Good: 24-26 Good knowledge of the topics contained in the program, good in-depth and analysis skills on the different specific parts of the program, good analytical and critical skills, overall correct and technically adequate language Distinguished: 27-28 More than good knowledge of all the topics contained in the program, good in-depth and analysis skills on the different specific parts of the program, good connection skills between the different topics, good analytical and critical skills, overall correct and technically adequate language, with a good command of specific technical terminology Great: 29-30 Excellent knowledge of all the topics contained in the program, excellent ability to deepen and analyze the different specific parts of the program, excellent skills in connecting the different topics, excellent analytical and critical skills, overall correct and technically adequate language, with mastery more than good of the specific technical terminology Excellent: 30L Excellent knowledge of all the topics contained in the program, excellent ability to deepen and analyze the different specific parts of the program, excellent ability to connect between the different topics, excellent ability to analyze and criticize, overall correct and technically adequate language, with excellent mastery of specific technical terminology

Teaching tools

In addition to the texts recommended in the "Texts / Bibliography" section, the relevant regulatory sources and, in particular, the Code of industrial property / legislative decree are an indispensable tool for the study of the subject matter. 30/2005 and succ. Modification. and integr.) and the law on copyright (Law 22 April 1941, No. 633 and subsequent amendments and supplements).
