Learning outcomes

The objective of teaching is to provide basic knowledge of the general principles and the main institutions for carrying out the professional activity. At the end of the course the student is able to:

a) recognize of the symptons of insolvency

b) identify which entities may fail

c) assess the effects of the failure declaration and select the tools to prevent these effects

 

Course contents

The failure the conditions for the failure, the declaration; the organs of failure; the effects of failure on the pre-existing legal relationships; the ordinary and bankruptcy revocation; the administration and custody of the assets of the failed; the rent of the businness and the provisional exercise, the allocation of the assets; the closing of the bankrupticy; the failure of the company the failure concordat ; the repayment ;

the preventive concordat ; the concordat in blank and with businness continuity; the debt restructuring agreements; the compulsory administrative liquidation; the extraordinary administration of large companies in crisis
