Learning outcomes

Achieve an analytic knowledge of the principles of family law and of the leading decisions in case law.

Course contents

- Family law in an historical prospective.

- Family law, Constitution and International law.

- Marriage.

- Personal relationships.

- Economic relationships.

- Dissolution of the marriage.

- Economic consequences of the dissolution of the marriage.

- Civil partnership (L. n. 76/2016).

- The reform of L. n. 219/12 and D. lgs. n. 154/2013 concerning the condition of the child.

- Assisted reproductive technologies.

- Adoption.

- Tort law in familiar relationships.

Teaching methods

Lessons will be delivered by Prof. Luigi Balestra and by Prof. Marco Martino.

The cours will focus on case law.

Power point slides will summarize the most relevant principles and cases.

Students can take examinations starting from January 2019.

Assessment methods

Oral examination, focusing on the student's ability to give a complete and accurate picture of the topics, moving from cases discussed during lessons and in a general perspective.

The evalutation will focus on the topics indicated in the "Program and contents" section.

The evaluation of the test will be carried out taking into consideration:

- Knowledge of institutional profiles

- The ability to analyze the jurisprudential and doctrinal guidelines

- The ability to make connections between the different parts of the program

- The ability to develop critical arguments

- The articulation of the exposure

- Accuracy of exposure

In order to take the exam, istudents must have successfully taken the examinations of Private law and Costitutional law.

Registration for the exam must be made through the Almaesami application (https://almaesami.unibo.it/almaesami/welcome.htm ).

The degree thesis will be assigned by Prof. Marco Martino after an interview.

Teaching tools

Topics will be explained to the class accompanied by the projection of graphic slides and summary tables in Power Point.

Students needing compensatory tools for reasons of disability or specific learning disabilities (DSA) shall communicate their needs to the teacher so as to be directed to the dedicated person and arrange on the adoption of the most appropriate measures.
