Learning outcomes

At the end of the course the student knows the main features and changes that are taking place in the Italian administrative system. He knows the relevant legislation concerning the organization and activities of Public Administrations. It is able to understand, in particular, the influence of Constitutional principles on administrative law, the importance of organizational principles in order to assure impartiality and responsiveness of Public Administrations, the role of civil law and public law, the peculiarities of the administrative jurisdiction.

Course contents

The course aims to provide the legal concepts and research methods useful to understand the main characteristics and the changes of the Italian administrative system, due to the incessant reforms that have affected the public sector, always looking for the right balance between fairness and efficiency, impartiality and simplification.

 
The course is divided into four parts.


After an introduction on administrative law and its principles (more or less extensive depending on the degree of institutional knowledge of administrative law by attending), it deals with:

- The administrative organization and its humas and material resources;

- The discipline of the (public law and private law) of the Public Administration;

- The system of administrative responsibiliy, and an introduction to administrative justice and the protection of citizens against acts and conduct of government.

Students who have already addressed during the fist level degree administrative law can agree with the teacher a differentiated programme, which will take into account the programme already carried out and the time passed from the first examination.

Teaching methods

Lectures, accompanied by the illustration and discussion of judicial cases, which will be made available on line.

Through the Web page of the teacher, students will also be informed about seminars and other scientific initiatives organized by the School of specialization in Studies on public Administration (SPISA) (www.spisa.unibo.it), useful to deepen the topics of the exam.

Assessment methods

The exam is oral.

In addition to knowledge of  the key concepts explanied during the course, assessment will take account of the knowledge of legal terminology.

 

For the attending students, the examination will take into account in particular, in addition to the knowledge of the topics explaneed during the lessons, the the ability to present and critically discuss the judicial cases.  Fpr this purpose, the first part of the examination will consist in the illustration of two of these cases, at the student's choice.
