Learning outcomes

THE EQUAL OPPORTUNITIES LAW COURSE TAKES PLACE IN PRESENCE ONLY AND IS LIMITED TO 25 STUDENTS.

TEACHING METHODS AND ANTI-COVID MEASURES

Master's Degrees - "Structured Seminar" model - Can only be activated for optional teaching of Master's Degrees with NO more than 25 students.

In view of the health emergency, which it is anyway will be resolved, the teaching of Equal Opportunities Law, due to its peculiarities, will be taught as a structured seminar model.

Students interested in attending must therefore contact the teacher by email BEFORE the start of the lessons to register and in any case the number of participants in the course may NOT exceed 25.

If health conditions permit, the entire course will be held in presence with 1 weekly meeting of 4 consecutive hours (Thursdays from 9 a.m. to 1 p.m.).

If this is not possible, the course will be conducted remotely via MS Teams.

Participation in the course requires that students come to class having read any material already assigned by the lecturer. Active participation is always required.

The objective of the Equal Opportunities Law course is a complex one that appears particularly relevant in the light of the current political-institutional debate, considering the growing importance of equality in all its various facets at national, European and international level.

The teaching path starts from the Constitution, highlighting the key role of equality. It starts by examining Article 3 and then declines the principle of equality in the different parameters that are specified by the Constitutional Charter: gender, religion, language, race, personal conditions, to verify what has been done and what remains to be done for the principle of equality to be fully realised in the daily practice of institutions and society.

Since 2019-2020 academic year, the course has changed the teaching system, 'experimenting' with a new approach that accompanies the lectures, the examination of the Constitution, the study and knowledge of domestic and foreign legislations and judgments with the viewing of a number of picture that 'stage' specific situations of equality/inequality. These pictures and docu-films have real stories as starting points and are preceded and followed by theoretical reflections on the specific parameter under discussion.

Lectures will be based on slides, judgments and normative references also from a comparative perspective.

Teaching in the 2022-23 academic year will be particularly focused on women's bodies, the principle of self-determination and the right to health from the perspective of so-called Sex and Gender Medicine. In this regard, the conference on Thursday 24 November 2022 entitled "Equality and equity of care. The response of Sex and Gender Medicine' is part of the course.

The course aims to provide students with:

1. the tools necessary to understand the emergence and establishment of the principle of equality;

2. the ability to understand what a stereotype is and when it turns into a prejudice;

3. the ability to evaluate the consequences of the principle of equality;

4. the ability to interpret national, European and international legislation and jurisprudence on equality;

5. the ability to understand the significance of institutional changes and the weight of such transformations with respect to the general legal system, with a view also to highlighting what steps still need to be taken to really bring the principle of equality to fruition in its various declinations.

Course contents

The target of this course is a complex. This is why a preliminary introduction to the principle of Equality is required. After that specific parameters provided in Art. 3 of the Constitution will be analyzed in detail, too.

Further reading materials (laws, judgments, conventions...) for participants will be distributed by the Professor via mailing list or in class.

It is recommended to always have a copy of the Constitution at hand.

NON-ATTENDING STUDENTS

The texts adopted for NON-attending students are the followingas follows:

Consultation and knowledge of the Italian Constitution is INDISPENSABLE.

Teaching methods

The course will start with an in-depth analysis of Constitutional principles and Justice, stressing in particular the Equality principle; Then, Italian and European laws regarding equal opportunities will be analyzed, both from a national and a comparative perspective, too.

This course includes two different paths, for attending and non-attending students, respectively. Attending students are students following not less than 75% of lessons. After every lesson, students will be requested to sign out. Attendance records will be kept by the teacher.

Assessment methods

The course envisages two different courses for attending and NON-attending students.

Those who have attended at least 75% of the lessons are considered to be attending.

Attendance records will be kept for each lesson.

For those attending, knowledge of the subject will be acquired by reading and discussing the textbook (F. Rescigno, Per un habeas corpus “di genere”. Salute, autodeterminazione femminile, sex and gender medicine, Editoriale Scientifica, Napoli, 2022,) watching films, and studying the slides, notes, sentences and various regulations provided by Professor Rescigno during the course.

Specific in-depth discussions with guests and experts are also planned. In this regard, the conference on Thursday 24 November 2022 entitled 'Equality and equity of care. The response of Sex and Gender Medicine' is part of the course.

At the end of the course, each participant is expected to give a presentation to the Professor and the class on a specific topic agreed in advance with the Professor.

The presentation may take the form of a paper, video, simulation, etc.

For those NOT attending, knowledge of the subject will be acquired through the study of:

with the passing of a 'traditional' oral examination

Methods of verification and evaluation of learning

The exam for those attending will be passed with a presentation to the class and the lecturer on a specific topic agreed in advance with Professor Rescigno.
