Learning outcomes

KNOWLEDGE AND SKILLS TO BE ACHIEVED:

at the end of the course the student has the knowledge of the international, European and national public legal regulation in the field of environmental law, with particular reference to the actual and effective impact of these on the concrete development of the entrepreneurial activity.

Course contents

  CONTENT PROGRAM:

1. Legal protection of the environment at international level (in particular WTO)

2. The legal protection of the environment at European level (in particular the Treaty and the Single European Act): the dimension of the Union's environmental policy in the judgments of the Court of Justice and their impact on national companies

    2.1 "Eco-competitive" economic actors, public aid and green payments, the Community Eco-Management and Audit Scheme (EMAS - Eco Management and Audit Scheme)

3. The legal protection of the environment at national level: the constitution, the codification of environmental law (in particular the environmental code), regional and local sources

     3.1 The principle of sustainable development

     3.2 Market instruments and environmental protection: green               procurement subsidies, permits and negotiable certificates

     3.3 Specific procedures: VIA, VAS, AIA, AUA. Limits to                         simplification

     3.4 The burdensome administrative bureaucratic procedures                 for  the entrepreneur: administrations as an obstacle or as             a moment of balancing the interests

The book adopted is Environmental Law, edited by B. Caravita, L. Cassetti, A. Morrone, Il Mulino, 2016. In particular, the student will focus his attention on the present chapters:

Teaching methods

The course is expected to be held in frontal lessons; nevertheless, during the lessons, some judgments of the European Court of Justice will be distributed, which will be the object of the student's exposures in the classroom.

Assessment methods

The final exam will be held orally.

Teaching tools

To support the teaching will be used slides and some judgments of the Court of Justice on the individual topics dealt with, which will be inserted directly by the teacher on her site.
