Learning outcomes

The aim of the workshop is to introduce students to the legal dimension of the most current issues related to environmental and socio-cultural challenges (management of diversity and pluralism). At the end of the Laboratory, the student is able to: - know the philosophical and legal foundations of the Welfare State and the Caring State; - translate environmental and cultural conflicts into legal cases; - prepare and argue for the defence of one of the parties to the conflict in simulated debates or trials.

Course contents

The laboratory will consist in the simulation of the legal drafting of a Declaration of the rights of the Mediterranean Sea.
Students will be provided with the theoretical and practical tools to deal with the simulation of legal drafting, aimed at the elaboration of the Declaration. To this end, the following topics will initially be addressed:
- review of national, international and supranational regulatory sources
- how to carry out a legal bibliographical research
- watching a documentary on the effects of climate change
- study of the concept of "nature rights"
- the stages and methods of legislative drafting
Subsequently, the lessons will be organized in the form of a constituent assembly, through the identification of stakeholders (division of students into groups); approval of the internal regulation of the Assembly; Constitution of 3 thematic committees; a plenary assembly with declarations of vote and final vote on the text of the Declaration

Readings/Bibliography

The laboratory does not provide for the adoption of a text or a teaching manual. Students will be asked to read in advance some  documents or articles that will be indicated by the teacher during the course and provided in electronic format to the students on Virtuale.

Teaching methods

The workshop is ideally divided into two teaching modules. The first five meetings consist of lectures preparatory to the seminar work of the second module, in order to equip students with the necessary tools to deal with the simulation of the drafting process of the Declaration of the Rights of the Mediterranean Sea.
The last five meetings simulate the process of drafting the Declaration. Students will be asked to work at home in group, drafting the articles and amendments that will be discussed and voted on in the next lesson. In the last lesson, there will be the debate and vote on the entire text of the Declaration in a plenary session.

Assessment methods

In order to pass the exam, each group of students will present in class their own legislative proposals and a  final declaration of vote on the entire text of the declaration. Each group will have to send to the teacher, at the end of the workshop, a word file with the texts presented in class.

Attending students are those students who will be present at least at 70% of classes.
