Learning outcomes

At the end of the course, students acquire the knowledge of state legislation concerning the protection and enhancement of cultural heritage, with particular regard to the organization of the Ministry for Cultural Assets and Activities and the provisions contained in the Code of Cultural Heritage and Landscape (Legislative Decree January 22, 2004, n. 42).

Course contents

The course, in addition to being an opportunity to acquire some general notions of law (sources of law, relationship between national and supranational law, relations between the State and the Churches, general principles of administrative action, etc.), provides the essential legal knowledge – both national and supranational (UNESCO) – relating to cultural heritage, taking into account the religious and historical context in which these goods are inserted. Particular attention is paid to the study of practical cases and to jurisprudential and/or regulatory solutions gradually adopted (Street art; destruction, damage, subtraction, counterfeiting, movement of cultural goods; sale of museum goods, etc.).

If students wish to examine more thoroughly a particular topic, the Professor will be available to suggest further textbooks.

At the beginning of the course, attending students may agree to integrate or replace some parts of the program with specific bibliographic references. The same will apply to students taking part to practical exercises.

Teaching methods

Teaching will take place throughout lectures where it will highlight main features of:

- cultural heritage legal sources;

- How to identify a heritage site or a good of cultural interest;

- administrative functions of "protection" and "promotion" of cultural property at the different government level;

- practical cases.

With respect to the subjects to be used for exercises and seminars, work groups focused on writing can be organised. In case of a positive valuation, the teacher will take it into account for the final valuation, limiting the oral examination to those parts that were not treated in those written texts.

A special attention will be guaranteed to the comparison and direct dialogue with the students, who will be able, during the lessons, to make proposals for deepening the debate.

To provide maximum information and coordination during lectures, students are encouraged to always check the website of the teacher as well as any information concerning the course.

On the teacher's website, students can find a collection of important administrative laws and documents.

Assessment methods

The final exam is oral (with possible pre-checks in written form) and the evaluation will be expressed in thirty-one.

The discussion will focus on the topics related to those outlined in the "Course contents" section, in order to verify the acquisition by students of the knowledge imparted during the course.

In the final evaluation, it will be possible to take into account the results of the pre-ceck and the papers written (individually or in groups) during the practical exercises.

The evaluation will take into consideration:

• knowledge of institutional profiles;

• knowledge of case law and legal doctrine;

• connections between different parts of the program;

• debate skills;

• speaking ability;

• speaking accuracy.

Enrollment in the final exam can only be made on-line via the University web site.

An exhaustive development of the answer from which a clear understanding of the subject covered in the textbook emerges, with demonstration of critical sense, formation of logically coherent thinking and use of means of expression appropriate to the disciplinary context will be evaluated with the maximum scores in the 'grade range 27-30 with honors.

A discussion that denotes an adequate ability to identify the relevant theoretical analysis tools, the use of language expressions appropriate to the disciplinary context, partially satisfactory logical skills will be evaluated with a score included in the score range 21-26 .

The evidence of minimal acquisition of the analysis tools presented during the course, with inadequate verbal expressions and logical skills will be evaluated with a score in the range 18-20.

The absence of a minimum acquisition of the course subject, combined with inadequate verbal expression and logical skills, will be evaluated with insufficient marks.

To make more complete study and investigation of the issues discussed during lectures and seminars students shall indicate additional teaching materials, in addition to the texts specified above.
