Course contents

The complexity of the subject and the difficulty on identifying the precise extent are evidenced also by the different definitions of University courses dealing with the Criminal Law from a Commercial standpoint  to Criminal law when it comes to major Firms and Companies, we will comprehensively cover the Criminal Law of the Business as well as the Criminal Law of the Economy intended as an overall.

The European Union, during the last years of the twentieth century and the beginning of this century, has undertaken a position on their Directives which has been characterized by attempts to rework the various materials in order to harmonize the effects on the incidence and the impact of sanctions, as well as to adapt the rules dating back to the principles of security and the development of criminal science.

The comparison between the doctrinal positions and orientations of case law covered by this course will also offer the opportunity to check - on the field and by reviewing heated disputes - the tension between the development theoretical and the so-called “living law”.

Hence, the main objective of this teaching activity will be to allow students to be aware of the legislative framework “in a framework of reference”, with a strong orientation on cultivating the analysis of a business structure capable to prevent the consummation of crimes (and violations of administrative sanctions that may assist them) by exploring subjects and promoting a "corporate culture", leading to exclude the configurability of a charge to "blame the organization ".
